GENERAL TERMS OF SALE – CONSUMERS – INTERNET (PRODUCTS)
ARTICLE 1 – Scope of Application
These General Terms of Sale (GTS) apply without restriction or reservation to all sales concluded by Poster Swiss, hereinafter referred to as “the Seller,” with consumers and non-professional buyers, hereinafter collectively or individually referred to as “the Client,” wishing to purchase the products offered for sale by the Seller, hereinafter referred to as “the Products,” on the website: www.poster-swiss.ch.
These General Terms of Sale specify, in particular, the conditions of ordering, payment, delivery, and the return procedures for Products ordered by Clients.
They may be supplemented, if applicable, by specific conditions published on the website before any transaction.
These GTS prevail over any other conditions, including those applicable to in-store sales or through other distribution and marketing channels.
They are permanently accessible on the website www.poster-swiss.ch and prevail over any prior version or conflicting document.
The Seller reserves the right to modify these GTS at any time; the version applicable to an order is the one in effect on the date the Client validates their order.
Poster Swiss places particular importance on clarity and transparency in its commercial relations with Clients.
ARTICLE 2 – Products Offered for Sale
The Products available for sale on www.poster-swiss.ch include, but are not limited to:

Posters and prints depicting various cities and landscapes of Switzerland;

The main characteristics of the Products (specifications, images, dimensions, materials, etc.) are clearly presented on the website.
It is the responsibility of the Client to review these characteristics before placing an order.
The selection and purchase of a Product are the sole responsibility of the Client.
Photographs and visuals on the website are provided for informational purposes only and are not contractually binding. They cannot engage the liability of the Seller.
The Client is invited to refer to the detailed description of each Product to understand its essential properties, delivery times, and, if applicable, the minimum duration of any contract related to continuous or periodic supply.
All contractual information is presented in French, and a summary confirmation will be communicated to the Client upon validation of their order.

Order Validation
By validating an order, the Client fully and unconditionally accepts these General Terms of Sale, without restriction or reservation.
Recognition of Client Capacity
The Client acknowledges that they have the legal capacity to contract and purchase the Products offered on the website www.poster-swiss.ch.
ARTICLE 5 – Orders
5.1. Placing an Order
The order process on the website www.poster-swiss.ch is carried out according to the following steps:

The Client selects the Products they wish to order by following the instructions displayed on the website.

Before final confirmation, the Client can review the order details, total price, and correct any errors.

The Client is solely responsible for the accuracy of the information provided and must immediately notify the Seller of any mistakes.

The order is considered registered once the Client accepts these General Terms of Sale by ticking the appropriate box and then validates the order.
By confirming the order, the Client fully accepts the General Terms of Sale as well as the Terms of Use of the website www.poster-swiss.ch.
The sale becomes final once the Seller sends a confirmation email to the Client, following receipt of full payment.
Any order confirmed by the Client and accepted by the Seller constitutes a distance contract between the two parties.
Unless proven otherwise, data recorded in the Seller’s computer system is considered proof of all transactions carried out.
The Seller reserves the right to refuse or cancel any order from a Client with an outstanding payment dispute regarding a previous order.
The Client can track the status of their order via the “Order Tracking” section on the website.
The website www.poster-swiss.ch is intended exclusively for sales to individual consumers for personal use. The Seller reserves the right to refuse any order deemed for professional purposes, including orders of more than 10 units of the same Product.
5.2. Modification of an Order

This request must be made at least 2 days before the scheduled shipping date.
The Seller will make every effort to accommodate the request, subject to feasibility. If modification is not possible, the amount paid will be refunded within a maximum of 15 days from the notification sent to the Client (unless the Client prefers a credit note or exchange).
Poster Swiss is committed to providing a transparent and responsive service to the best of its ability.
ARTICLE 6 – Prices
The Products are offered at the prices in effect at the time the order is registered on the website www.poster-swiss.ch.
Prices are indicated in Swiss francs (CHF), all taxes included (TTC), unless stated otherwise.
These prices take into account any discounts or promotional offers applicable at the time of the order.
Prices remain fixed and non-revisable during their validity period as indicated on the website. However, Poster Swiss reserves the right to change prices at any time for any future order that has not yet been confirmed.
The displayed prices include processing, packaging, transportation, and delivery costs, unless stated otherwise.
The total amount due by the Client corresponds to the overall price indicated at the time of order confirmation. Poster Swiss commits to ensuring full price transparency and avoiding hidden charges.
ARTICLE 7 – Payment Terms
Full payment is required at the time of order, before shipment of the Products, using the secure payment methods offered:

Payment by credit card is considered final, except in cases of proven fraud. In the event of fraudulent use of a credit card, the Client may request cancellation of the payment and a refund of the corresponding amounts, in accordance with legal provisions.
Poster Swiss takes all measures to ensure transaction security and provide clients with peace of mind.
ARTICLE 8 – Delivery
Products ordered by the Client will be delivered in Switzerland and serviced European countries, within an indicative period of 3 to 5 business days from the shipping date of the order. This timeframe includes processing, preparation, and transportation, according to the information provided on each Product page.
Delivery is considered completed once the Client takes physical possession of the Products or assumes control over them. Unless otherwise indicated or in case of temporary unavailability, all Products in a single order will be shipped together.
Poster Swiss commits to making every effort to ensure fast and reliable delivery within the announced timeframe. These times are indicative only. In case of excessive delay not attributable to the Client or a force majeure event, the Client may request cancellation of the order in writing. In such a case, Poster Swiss will refund the full amount paid within a maximum of 14 days from the cancellation notice, without penalty.
In the event of non-conformity or damaged Products, Poster Swiss will, at the Client’s choice, either replace or refund the Product, in accordance with the provisions of Article 11 (“Seller’s Liability – Warranty”).
The Seller assumes all transport-related risks. In case of damage during transport, the Client must report any anomalies (damaged package, missing Product, etc.) within a reasonable timeframe to allow the Seller to investigate with the carrier.
Deliveries are made to the address provided by the Client at the time of order. The Client is responsible for ensuring that this address is accurate, complete, and accessible to the carrier.
ARTICLE 9 – Transfer of Ownership and Risk
Ownership of the Products is transferred to the Client only after full payment of the agreed price, regardless of the delivery date.
The risks of loss or damage are transferred to the Client upon physical receipt of the Products.
Until that receipt, the Products remain under the responsibility of the Seller during transportation.
ARTICLE 10 – Right of Withdrawal
In accordance with European consumer law applicable to distance sales, the Client has a 14-day period from the receipt of their order to exercise the right of withdrawal, without justification and without penalty.
To exercise this right, the Client must inform Poster Swiss of their decision to withdraw by email sent to:

The Client will receive an acknowledgment of receipt of their request in a durable format.
The Products must then be returned within 15 days following the withdrawal notification, in their original condition, undamaged, and with complete packaging (including accessories, manuals, etc.).
Products returned incomplete, damaged, or soiled will not be accepted.
The refund will cover the price of the Products and the initial delivery costs. Return shipping costs are borne by the Client, unless the error is attributable to the Seller.
Refunds will be processed within a maximum of 14 days from the date the Seller receives either the withdrawal request or the returned Products, whichever occurs first.
ARTICLE 11 – Seller’s Liability and Warranty
Products offered on www.poster-swiss.ch comply with Swiss legislation and applicable quality standards.
Poster Swiss guarantees that the delivered Products are as described on the website and free from manufacturing defects at the time of delivery.
Applicable Legal Warranties
All Products automatically benefit, at no additional cost, from the following legal warranties:

Legal warranty of conformity: applicable if the Product does not conform to the order, is defective, or damaged upon receipt.

Warranty against hidden defects: covering latent defects that make the Product unfit for its normal use.
Duration and Conditions of Application
The Client has a two-year period from the delivery date to invoke the legal warranty.
Within this warranty, the Client may request, at their choice, repair, replacement, or refund of the defective Product, subject to reasonable cost conditions for the Seller.
During this period, the Client is not required to prove the existence of the defect if it appears within 24 months following delivery.
These warranties apply without prejudice to the right of withdrawal and at no cost to the Client.
Poster Swiss commits to providing a responsive and fair after-sales service and to process any claims within a reasonable timeframe.
ARTICLE 11 – Seller’s Liability and Warranty
The legal warranty of conformity is a legal protection for the Client. It applies independently of any additional commercial or contractual warranty that may also cover the Product.
The Client may therefore rely on this legal warranty without prejudice to any other warranties they may be entitled to.
Under Article 197 of the Swiss Code of Obligations (CO), the Client may also assert a warranty against hidden defects of the Product. In this case, the Client may choose to:

rescind the sale (return the Product in exchange for a refund), or
-
request a reduction of the sale price, in accordance with legal provisions.
This warranty protects the Client against defects that were not apparent at the time of purchase but discovered later.
To exercise their warranty rights, the Client must notify the Seller in writing of any non-conformity or defect within 14 days of delivery or upon discovering a hidden defect.
The Client must then return the defective Products in their original condition, complete with all accessories, packaging, and manuals.
In the case of confirmed non-conformity or hidden defect, Poster Swiss commits to:

refund,

replace, or
-
repair the Product or the affected part.
Initial shipping costs will be reimbursed based on the charged rate, and return shipping costs will be covered upon presentation of proof of payment.
Refunds will be processed within 14 days of the Seller’s confirmation of the defect, via bank transfer or credit to the Client’s account.
Poster Swiss shall not be held liable in the following cases:

Non-compliance with the legislation of the delivery country,

Misuse of the Product, professional use, or use inconsistent with its intended purpose,
-
Negligence, lack of maintenance, or accidents attributable to the Client,
-
Normal wear and tear,
-
Force majeure.
In all cases, the Seller’s warranty is limited to the replacement or refund of defective or non-compliant Products.
ARTICLE 12 – Personal Data Protection
In accordance with the Swiss Federal Data Protection Act (LPD) and the European General Data Protection Regulation (GDPR), Poster Swiss is committed to ensuring the confidentiality and security of its Clients’ personal data.
The personal data collected is necessary for processing orders, invoicing, delivery, and managing customer relations.
This data may be shared with technical or logistical service providers involved in processing or delivering the order, strictly to the extent necessary for their tasks.
The processing of information collected via the website www.poster-swiss.ch and the email address poster-swiss@gmail.com complies with all legal requirements regarding the protection and processing of personal data.

ARTICLE 13 – Intellectual Property
All content on the website www.poster-swiss.ch — including text, graphics, logos, photographs, visual creations, illustrations, videos, and source code — is the exclusive property of Poster Swiss or its partners and is protected by Swiss and international intellectual property and copyright laws.
Any reproduction, representation, modification, or dissemination, in whole or in part, of the website content without prior written authorization is strictly prohibited and may constitute an act of copyright infringement under the law.
ARTICLE 14 – Force Majeure
Neither Party shall be held liable for non-performance or delays in performing its obligations due to force majeure, as defined under Swiss law and the jurisprudence of the Code of Obligations.
Force majeure events include, but are not limited to:

Natural disasters, fires, floods

Interruptions of transport or postal services

Telecommunication network failures
-
Wars, riots, or general strikes
The performance of contractual obligations is suspended for the duration of the force majeure event.
ARTICLE 15 – Applicable Law and Jurisdiction
These General Terms and Conditions of Sale (GTCS) and all related transactions are governed by Swiss law.
They are drafted in French. In case of translation into another language, the French version prevails in the event of a dispute.
Any dispute relating to the interpretation, performance, or validity of these GTCS shall be subject to the exclusive jurisdiction of the courts of the Canton of Vaud (Switzerland), unless mandatory legal provisions state otherwise.
ARTICLE 16 – Disputes and Dispute Resolution
In case of a dispute concerning the interpretation, validity, performance, or termination of these GTCS, the Parties shall first attempt to resolve the dispute amicably.
If no agreement is reached within a reasonable time, the dispute shall be submitted to the competent courts of the Canton of Vaud (Switzerland), unless mandatory legal provisions dictate otherwise.
The Client also has the option to use alternative dispute resolution methods, such as mediation or conciliation, in accordance with practices in Switzerland and the European Union. These procedures offer a friendly, fast, and cost-effective solution for resolving disputes without judicial recourse.

ARTICLE 17 – Pre-contractual Information and Client Acceptance
Placing an order on the website www.poster-swiss.ch implies the Client’s full and unconditional acceptance of these General Terms and Conditions of Sale.
This acceptance also includes the Client’s obligation to pay the total amount due for the Products ordered.
The Client acknowledges having read, prior to placing the order, all necessary legal and contractual information, including:

No specific condition or contradictory document shall prevail over these GTCS, except by express written agreement signed by the Seller.
ANNEX 1 – Provisions on Legal Warranties (Swiss law version)
1. Legal warranty against defects (Articles 197 to 210 of the Swiss Code of Obligations)
The Seller is obliged to deliver a Product free from any defect that would reduce its value or suitability for its intended use.
This warranty covers both apparent defects at the time of delivery and hidden defects discovered later.
The Client is required to inspect the Product upon receipt and immediately notify the Seller of any defect found.
If a hidden defect is discovered later, it must be reported in writing as soon as it is discovered.
The Client may choose to:

Request rescission of the sale (return of the Product for a refund), or
-
Request a proportional reduction of the purchase price.
2. Duration and Conditions
Any action resulting from an apparent defect or hidden flaw must be initiated within two years from the delivery of the Product, in accordance with Article 210 of the Swiss Code of Obligations.
3. Warranty Limitations
The legal warranty does not apply in the following cases:

Non-compliant or improper use of the Product

Normal wear and tear or damage due to mishandling

Unauthorized modification of the Product

Negligence, accident, or force majeure
4. Commercial Warranty (if applicable)
Certain Products may benefit from a specific commercial or manufacturer warranty, indicated on the Product sheet or in the packaging.
This warranty adds to the legal warranty and does not in any way limit its application.
